These Terms & Conditions ("Terms") govern your use of Mom Nom (the "Service"), provided by Stepheni Mendez, an individual doing business as Mom Nom ("Mom Nom", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Mom Nom is a family meal-planning application that provides weekly meal plans, recipes, shopping lists, and nutrition summaries. Some features are powered by generative AI (see Section 8).

2. Eligibility

You must be at least 13 years old to use the Service and be legally able to enter a binding contract. If you are using the Service on behalf of a household or other group, you represent you have authority to bind them to these Terms.

3. Your Account

You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it current.

4. Acceptable Use

You agree not to:

• use the Service for any unlawful, fraudulent, or abusive purpose;
• infringe intellectual property or privacy rights of others;
• upload malware, probe or scan the Service, scrape or interfere with security;
• reverse engineer, resell, or redistribute the Service;
• circumvent usage or plan limits.

5. Payments, Subscriptions & Refunds

Mom Nom Pro is offered as a paid subscription (monthly or annual) with a 7-day free trial. Our order process, billing, tax, cancellations, and refunds are handled by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Please review Paddle's Buyer Terms. 6. Intellectual Property

The Service, including its software, design, recipes catalog, and branding, is owned by Mom Nom and its licensors and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for personal, non-commercial household meal planning within the plan you have selected.

7. Your Content

You retain ownership of the recipes, notes, and other content you add ("Your Content"). You grant Mom Nom a limited license to host, process, and display Your Content solely to operate the Service for you.

8. AI Features — Important Notice

Certain features generate content using large language models ("AI Outputs"). You agree that:

• You are responsible for your prompts, the recipes and family information you provide, and for reviewing AI Outputs before relying on them.
• You must have the rights to any content you paste in or link to for adaptation.
• AI Outputs may be inaccurate, incomplete, or unsafe (for example, missing an allergen). Mom Nom is not a substitute for professional dietary, medical, nutritional, or allergy advice. Always verify ingredients against every household member's allergies, medical conditions, and preferences before cooking or serving.
• You will not use AI features to generate illegal, hateful, deceptive, or harmful content, or to attempt to jailbreak, exfiltrate prompts from, or otherwise misuse the models.
• We may filter, refuse, or remove AI Outputs, and suspend accounts that repeatedly violate this policy.

9. Third-Party Services

The Service integrates third-party providers (payments, hosting, AI model providers, recipe-import providers). Their terms and privacy notices apply to their handling of your data.

10. Service Availability

We do not guarantee uninterrupted or error-free operation. We may modify or discontinue features at any time.

11. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

To the fullest extent permitted by law, Mom Nom's total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, incidental, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (including fraud, death, or personal injury caused by our negligence).

13. Indemnification

You will indemnify and hold harmless Mom Nom from any claims arising out of Your Content, your misuse of the Service, or your breach of these Terms.

14. Suspension and Termination

We may suspend or terminate access at any time for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends immediately. You may export or delete Your Content within a reasonable window after termination.

15. Changes to These Terms

We may update these Terms; the "Last updated" date will reflect the change. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which the seller is domiciled, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in that jurisdiction.
